ELECTRICAL SYSTEM—maximum aggregate liability is $400.00.
COVERED:  Breakers, panels, and sub-panels, conduit and junction boxes.
NOT COVERED:  Meter  boxes, service entrance cables, wiring, receptacles, switches, fuses, light fixtures, water damage, loss arising out of power failure or conditions of overload, and electrical system or wiring located outside the main foundation of the home.

PLUMBING SYSTEM—maximum aggregate liability is $600.00.
COVERED:  Leaks in visible above ground water, drain, gas, vent or sewer lines in accessible areas of the house.  Water heaters up to 80 gallon gas or electric, temperature and pressure relief valves, control thermostat and thermocouple, gas valves and drain valves.  SUMP PUMP:  Primary sump pump only.  Auxiliary sump pumps are not covered.  Water well pump for house water only.
NOT COVERED:  Sink, bath tubs, toilet tank and bowl, shower base pans, tub enclosures, fixtures, tub diverter, faucets, toilet tank assemblies, stoppages in drain vent or sewer lines, tile fields, leach beds, sewage ejectors, grouting, caulking, tile, lawn sprinklers, mineral deposits, cracking and chipping of porcelain, storage or holding tanks, loss due to insufficient capacity or rust.  Plumbing located outside the main foundation of the home, and inside the walls or floors.  Insufficient or low water pressure.  Water quality.  Water heater tanks and vents.  Oil water heaters.  Loss due to insufficient capacity, mineral or chemical deposits, rust-out.  SEPTIC TANK OR MECHANICAL WASTE SYSTEM.

ROOF COVERAGE (Repair Only) – maximum aggregate liability is $400.00
COVERED:  Rolled roofing and asphalt shingles for leaks and flashings only.
NOT COVERED:  replacement of entire roof, rotted wood, flat roofs and/or any roof that is not tar based.

WOOD DESTROYING INSECT AND STRUCTURAL COVERAGE:  No coverage.  Evidence of wood destroying insects observed during the inspection will be reported, however the home purchaser is advised in any case to have a licensed and insured insect and pest inspection conducted.

IF YOU HAVE A FAILURE IN A COVERED SYSTEM DURING THE SIX MONTH LIMITED WARRANTEE PERIOD CALL 231-723-4395.  In most cases, during normal business hours, someone will provide you with the phone numbers and names of contractors that are approved to repair your home.
1.    It is your responsibility to choose a contractor from our list and call to schedule repairs.
2.    You must pay the bill in full and submit a claim to us for reimbursement.  You will be responsible for the first $95.00 of any repair on each problem.  We will reimburse the remainder of the bill during the six month limited warrantee period, after the $95.00 service charge, if the conditions set forth in this contract are satisfied.
3.    Only contractors that are on our approved list will be covered during this limited warrantee.  If you employ the services of an unapproved contractor we will not reimburse your expense or provide repairs for the system in question.
It is your responsibility to select an approved contractor and check this form and your “Complete Home Analysis” report for qualification of approved repairs.  The people that answer our phones during business hours will help you through the process.  We will mail a claim form to you when you call us with a problem and request a contractor list.

LIMITS OF LIABILITY

1.    The Company will not reimburse you for services performed that do not qualify for coverage, or for work done by contractors that are not on our approved list.  No claims that occur six months after the home inspection was performed will be honored. Total aggregate liability for all claims is $1,000.
2.    The Company will not upgrade equipment or make improvements due to lack of capacity or failure to meet city, state, federal, or utility regulations or upgrades required by law.
3.    Common areas of facilities of mobile home parks and condominiums are not covered.
4.    Company is not responsible for repairs or replacements required as a result of missing parts, fire, war, flood, smoke, water damage, lightning, freeze, earthquake, theft, storms, accidents, rust out, rots, vandalism, code violations, improper installation, acts of God, pest damage or misuse.
5.    Company is not liable for consequential or secondary damage, nor for service relating to any toxic material.
6.    Company has the sole responsibility in determining whether to repair or replace.
7.    Company’s liability is limited to systems failure due to normal wear and tear.
8.    Manufactured/Mobile homes built or manufactured prior to 1980 will not be covered.
9.    This contract is non-cancelable except for fraud or misrepresentation of facts material to the issuance of this contract.
10.    This limited warrantee is not transferable. Coverage is in effect only when the house is titled in the name of the person or persons on this contract, and only if the house has changed ownership to that party after the inspection.
11.    When it is necessary to open floors, walls or ceiling to make repairs, the cosmetic repairs will be your responsibility.
12.    All systems are replaced with standard makes and models.
13.    The $95.00 service charge applies to each “Trade Call”.  A “Trade Call” is a repair or service call by a service contractor to the residence covered hereunder for the repair or assessment of one or more parts of one covered system.  If repairs are made to parts of additional systems, a separate deductible will apply to each system repaired.
14.    ARBITRATION CLAUSE:  Any dispute arising under this agreement shall be submitted for binding arbitration under the auspices of the Construction Arbitration Services, Inc. local office.  Each party shall pay for its own representative and shall bear arbitration cost equally.  The Arbitrator’s Award shall be final and binding and may be enforced by any Court of Law.
15.    The contractors selected by you from our list will be individually responsible for their work and any claims or problems that ensure from their work.  We are indemnified and held harmless for the results for their actions.
16.    This limited warrantee is not valid until the home buyer signs this contract and takes possession of the home.  Payment for the “Complete home Analysis” must be made prior to the buyer taking possession of the home in order for the limited warrantee to be valid.
17.    The aggregate liability limits of this limited warrantee are the inspectors’ total liability in this transaction.
